Employment Law prosecutes employee discipline cases under the Civil Service Law, defends the agency in discrimination cases filed by agency employees, handles receipt of subpoenas and Freedom of Information Law requests. The Legal Process and Records Access Unit (LPRAU) of the Employment Law Division handles all incoming requests for DSS/HRA/DHS agency records. This includes providing policy statements and legal responses, quashing subpoenas that seek records that are not subject to release, responding to Freedom of Information Law (FOIL) requests pursuant to the NYS Public Officers Law, defending any appeals challenged through New York Civil Practice Law and Rule (CPLR) Article 78 proceedings, and responding to client case requests pursuant to agency policy or procedures. The LPRAU is also responsible for tracking incoming requests and maintaining files according to city and state records retention requirements; retrieving requested records directly from the various administrative and program areas; determining whether records may be released under applicable federal, state, and local laws; providing records subject to release; intake and tracking of legal papers served on the agency to ensure all papers are properly routed to the appropriate division within the Office of Legal Affairs and handled in a timely fashion.
The Office of the General Counsel/Office of Legal Affairs is recruiting to fill one Clerical Associate III position, to function as a Subpoena Clerk in the Employment Law Division. Under the supervision of the Assistant General Counsel, the Subpoena Clerk provides administrative and clerical support for the Subpoena Unit. The Subpoena Unit is responsible for overseeing the receipt and distribution of legal subpoenas for DSS/HRA/DHS.
- Uses computer based applications, inputs and tracks incoming legal papers by inputting basic case data, also generates various reports indicating volume.
- Covers the subpoena window by accepting legal papers served by outside attorneys, process servers, law enforcement personnel, and clients.
- Responds to inquiries from program and OLA personnel regarding the receipt of legal papers.
- Maintains records including copies of legal documents and logs of incoming matters.
- Performs other related general clerical support functions including tracking and reporting on the usage of OLA's clerical service contract vendor.
Qualification Requirements
A four-year high school diploma or its educational equivalent approved by a State's department of education or a recognized accrediting organization and one year of satisfactory clerical experience.
Skills Requirement
Keyboard familiarity with the ability to type at a minimum of 100 key strokes (20 words) per minute.
