Under the direction of a Deputy Director and/or Supervising Attorney, with latitude for independent judgment and unreviewed action and decision, serves as a Senior Attorney, performing more
sophisticated agency legal work, including but not limited to the following:
- Provides legal guidance and support to attorneys, attorney internes, and other members of the Department.
- Prepares for, prosecutes and performs the necessary follow-up for legal cases.
- Reviews OATH decisions and respondent appeals to identify appeals and their responses.
- Legal writing, including motions, appeals and Department responses to appeals and other documents relating to the continued prosecution of DOB summonses.
- May assist with the development of training curricula and the facilitation of training sessions for attorneys and internes.
- Promptly and accurately notify AEU senior staff of important issues and the outcome of hearings, adjournments and other matters connected to summons prosecution.
- Performs in-house assignments relating to OATH’s adjudication of DOB summonses, including special projects and assignments.
- Carries out the duties of OATH/ECB Hearing Attorneys with respect to legal issues, cases and appeals.
- Perform the duties of unit supervisor in that person’s absence.
- Assist in the overall supervision of the Unit.
- Performs other related duties as instructed by the supervisors.
1. Admission to the New York State Bar; and either "2" or "3" below.
2. One year of satisfactory United States legal experience subsequent to admission to any state bar; or
3. Six months of satisfactory service as an Agency Attorney Interne (30086).
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
In addition to meeting the minimum Qualification Requirements:
To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.
- Experience with prosecution, defense or adjudication of summonses/violations at OATH/ECB. - Strong legal writing skills. - Experience in writing OATH/ECB appeals and other legal writing. - Demonstrated initiative, resourcefulness and ability to work independently and as part of a team on multiple assignments with minimal supervision. - Extensive experience with Building Code, Zoning, Multiple Dwelling Law or land use law. - Knowledge of Microsoft Office programs, Lexis-Nexis, Westlaw etc.
