The office of the General Counsel’s (OGC) Real Estate Unit works to efficiently execute the agency’s mission to acquire, dispose of and manage interests in real property on behalf of the City. Under OGC’s real estate unit, attorneys and supporting staff perform duties related to the acquisition by way of the leasing and licensing of commercial office, industrial, special use space and negotiated acquisitions of fee interests in real property to fulfill the City’s space needs, as well as the disposition of surplus non-residential real property by sale at public auction or otherwise if authorized, as well as the leasing and licensing out of City owned real property, including landlord/tenant litigation related thereto.
The New York City Department of Citywide Administrative Services (DCAS) seeks to hire an Agency Attorney with substantial experience in commercial landlord/tenant litigation. DCAS manages city-owned buildings with private tenants and licensees and manages the leases/licenses pertinent thereto. As directed by the General Counsel and Deputy General Counsel for Real Estate, the qualified candidate’s primary responsibility includes representing the city as landlord, in commercial landlord/tenant summary proceedings for all five boroughs as well as:

1) Providing counsel on commercial lease enforcement issues to the Real Estate Services short and long-term lease units within DCAS including directly handling all litigation practice on behalf of DCAS in such matters.
2) Reviewing/drafting of rent demands, surrender agreements, lease riders, vacate notices, petitions, affidavits of service pertinent to lease enforcement matters and additional Landlord-Tenant legal documents.
3) Serving as liaison with the NYC Law Dept. on agency and Law Dept. cases.
4) Reviewing pleadings and affidavits prepared by agency employees as well as monitoring and updating senior staff on ongoing matters.
5) Handling or participating in the handling of lease-imposed arbitration proceedings in connection with DCAS’ long term lease portfolio.


Minimum Qualifications

1. Admission to the New York State Bar; and either "2" or "3" below.
2. One year of satisfactory United States legal experience subsequent to admission to any state bar; or
3. Six months of satisfactory service as an Agency Attorney Interne (30086).
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
In addition to meeting the minimum Qualification Requirements:
To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.


Preferred Skills

The candidate must be able to manage and prosecute cases with relative independence and recommend legal options involving complicated fact patterns. This work requires considerable familiarity and expertise with respect to the landlord/tenant litigation practice within the five boroughs. At least two (2) or more years of Landlord- Tenant court experience subsequent to admission to the bar is the minimum requirement for this position. Detail oriented, excellent writing and time management skills are required.
