The Office of the General Counsel (OGC) serves as the chief legal advisor to DCAS, providing legal and strategic counsel across all twelve lines of service. OGC is organized into four primary legal units: Procurement and Operations, Real Estate Services, Human Capital and Workforce Oversight, and Policy and Compliance. Together, these units provide expert guidance on a broad range of matters critical to agency operations and citywide functions.

The Human Capital and Workforce Oversight (HCWO) Unit seeks a highly motivated professional to serve as the Senior Counsel II for the Discipline subunit. Under the management of the Deputy General Counsel with direct supervision from the Managing Counsel, the Senior Counsel II serves as the review support for Discipline.

- Lead the Disciplinary Unit in handling matters referred to OGC.
- Assist in the daily operation of the office.
- Conduct investigations by interviewing witnesses, gathering evidence, drafting a Statement of Charges for violations of the agency’s Code of Conduct, Conflict of Interest laws, and local, state or federal law.
- Draft memoranda of law, request and review relevant documents, audio, video, internal policies, and reports. Evaluating disciplinary matters for legal sufficiency.
- Prosecute disciplinary cases from inception to conclusion under New York State Civil Service Law and the City’s collective bargaining agreements.
- Prepare formal disciplinary charges. Represent the agency at Step-1 and Step-2 disciplinary conferences, OATH, the Civil Service Commission, the Office of Labor Relations, and in Section 76 appeals.
- Negotiate and prepare stipulation of settlements regarding disciplinary matters.
- Monitor compliance with stipulation of settlements.
- Provide guidance and make recommendations for disciplinary matters including time sensitive matters that require immediate action, including suspensions and terminations.
- Provide guidance to all authorized agency personnel either within the Department or throughout municipal government.
- Handle external disciplinary matters for other City agencies.
- Assist HCWO Labor and Human Capital subunits as needed.

Minimum Qualifications

1. Admission to the New York State Bar; and either "2" or "3" below.
2. One year of satisfactory United States legal experience subsequent to admission to any state bar; or
3. Six months of satisfactory service as an Agency Attorney Interne (30086).
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
In addition to meeting the minimum Qualification Requirements:
To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.


Preferred Skills

- JD from an accredited institution and a minimum of 8 years post-bar legal experience or the equivalent required. - Experience working in municipal government. - Knowledge of New York State Civil Service Law (preferably Sections 72 and 75). - Strong interpersonal and leadership skills. - Ability to independently act on priority projects. - Demonstrable ability to move projects from inception through operationalization in a timely manner. - Ability to prioritize and complete work assignments in a timely manner. - Ability to exercise critical, analytical, and problem-solving skills in a fast-paced environment and at times with extreme sensitivity.
