Under the direction of a Deputy Director, AEU Hearings with wide latitude for independent judgment and unreviewed action and decision, supervises legal staff or an important legal activity or engages in difficult and complex legal work having significant financial, procedural or policy consequences, including but not limited to the following:
- Provides daily supervision of OATH Hearing Representatives, OATH Hearing Attorneys, OATH Senior Hearing Attorneys, or other AEU Legal Matters personnel assigned to OATH tribunals and/or Department Headquarters.
- Provides legal guidance and support to attorneys, attorney internes, and other members of the Department.
- Liaises with OATH Managing attorneys and Borough Managers regarding the adjudication and handling of summonses issued by DOB.
- Prepares for, prosecutes, assigns (where appropriate) and performs the necessary follow-up for both standard and complex case.
- Reviews OATH decisions and respondent appeals to identify and/or assign appeals and their responses.
- Legal writing, including motions, appeals and Department responses to appeals and other documents relating to the continued prosecution of DOB summonses.
- May assist with the development of training curricula and the facilitation of training sessions for attorneys and DOB issuing officers.
- Promptly and accurately notify AEU senior staff of important issues and the outcome of hearings, adjournments and other matters connected to summons prosecution.
- Performs in-house assignments relating to OATH's adjudication of DOB summonses, including special projects and assignments.
- Carries out the duties of OATH Hearing Attorneys and OATH Senior Hearing Attorney with respect to difficult and complex legal issues and/or cases involving intricate determinations of law and fact.
- Perform the duties of a Deputy Director in his/her absence.
- Performs other related duties as instructed by the supervisors.
NOTE
The salaries on this posting reflect the agreement recently reached between the City and the Civil Service Bar Association, which has been ratified and is expected to be processed shortly.
1. Admission to the New York State Bar; and either "2" or "3" below.
2. One year of satisfactory United States legal experience subsequent to admission to any state bar; or
3. Six months of satisfactory service as an Agency Attorney Interne (30086).
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
In addition to meeting the minimum Qualification Requirements:
To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.
- A minimum of two years of experience with prosecution, defense or adjudication of summonses at OATH. - Strong legal writing skills. - Experience in writing OATH appeals and other legal writing. - Experience with training inspectors and/or attorneys. - Demonstrated initiative, resourcefulness and ability to work independently and as part of a team on multiple assignments with minimal supervision. - Extensive experience with Building Code, Zoning, Multiple Dwelling Law or land use law. - Knowledge of Microsoft Office programs, Lexis-Nexis, Westlaw etc.
