Job Description
The Affirmative Litigation Division of the New York City Law Department is accepting applications for an Intellectual Property litigator. The Intellectual Property litigator will handle both affirmative and defensive intellectual property litigation, particularly trademark litigation relating to the City’s marks and infringement of those marks. The attorney in this role also will advise City agencies, City Hall, and the City’s trademark licensing agent on matters related to copyright, trademark, and other intellectual property matters, supervise a trademark paralegal, and manage a trademark enforcement program. In addition, the attorney will work on other Affirmative Litigation commercial matters.
The Affirmative Litigation Division represents the City in a diverse and exceptionally interesting range of cases in federal and state courts and before administrative agencies where the City generally appears as plaintiff to advance key policy interests, to protect the City fisc, and to represent the City in the array of claims that arise in its operations.
After the completion of orientation, attorneys hired by the Law Department will have the opportunity to elect to work from home under one of the following two programs. The first option allows attorneys to work remotely on a limited and irregular basis. The second option is a Citywide pilot program, which allows participants to select two set days to work from home each week. The two days will need to be approved by the attorney’s division and take into consideration the needs of the division, as the pilot program requires more than 50% staff coverage each day. In addition, if an attorney needs to appear in court, a client meeting or other in-person work related event on a set work from home day, they will need to attend to those in-person responsibilities and will not be able to work from home that day. Participants in the pilot program must set one work from home location where they will work remotely. This pilot program is currently being tested Citywide to determine its efficacy for City agencies and is not yet a permanent program.

Applicants must be graduates of an ABA approved law school, admitted and in good standing with the NYS bar, and be admitted, and in good standing with, or eligible for immediate admission to the federal bar. Applicants for the Intellectual Property litigator position should have extensive federal court experience and experience before the US Patent and Trademark Office and the Trademark Trial and Appeal Board, as well as general commercial litigation experience. Applicants must have a minimum of 5 years of experience in this specialized area.
