NYC Department of Finance (DOF) is responsible for administering the tax revenue laws of the city fairly, efficiently, and transparently to instill public confidence and encourage compliance while providing exceptional customer service.
The Legal Affairs Division serves as the in-house legal department for DOF, providing professional and comprehensive legal advice and services supporting a full range of city tax and other revenue-related matters. Legal Affairs Division attorneys and staff handle various legal issues, including real property taxes and exemptions, business income and excise taxes, collections, parking violations, treasury, land registry, Conciliation Bureau conferences, FOIL, and employment law.
Legal Affairs is seeking an innovative, self-motivated Executive Agency Counsel to serve as Director for Information Law and Legal Counsel. Reporting to the Deputy Commissioner for Legal Affairs/General Counsel, the Director will manage Legal Affairs' information and data related functions and serve as a key resource on data and information legal issues. The Director will manage information law related functions including, privacy, information use, data sharing agreements, compliance, tax secrecy and disclosure, subpoenas, Freedom of Information Law and other externally focused in-house counsel functions such as providing legal advice on areas such as rules, compliance, discovery, treasury, bail, deposits into court and assigned counsel.
Under general direction with wide latitude for the exercise of independent judgment and legal knowledge, the Director will supervise Agency Attorneys and staff and perform the following:
- Manage Legal Affairs attorneys and coordinate a wide array of agency counsel work on information, privacy, data, security, compliance and disclosure, FOIL, treasury, litigation support and other matters assigned to the unit. Collaborate with the Law Department and other external agencies as needed on agency legal matters, issues, and litigation.
- Draft, review and advise on MOUs and information sharing agreements and projects, reviewing use cases and information requests for compliance with tax secrecy, disclosure laws and agreements.
- Work with External Affairs and DOF operating divisions on customer, policy and agency communications, legal notices or forms, reports and instructions as needed.
- Provide expert guidance on strategic projects. Handle data and compliance matters and agency matters in other areas assigned to the unit.
- Create and manage reports for the General Counsel and Legal Affairs management.
- Coordinate drafting and review of legislation and rules, and publication of the Regulatory Agenda.
- Collaborate with operational managers to implement strategies for new programs and legislative and policy changes, and with directors and teams in Legal.
- Provide legal advice and guidance to DOF operating divisions, managers and Executive on a wide range of issues.
Admission to the New York State Bar; and four years of recent full-time responsible, relevant, satisfactory legal experience subsequent to admission to any bar, eighteen months of which must have been in the supervision of other attorneys, in an administrative, managerial or executive capacity, or performing highly complex and significant legal work.
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
