Job Description

Under the supervision of the Director for Administrative Enforcement Unit (AEU) Legal Matters with a wide latitude
for independent action and decision making, performs Department legal work. Responsibilities to include:
- Performs daily supervision and training of Agency Attorneys and Internes assigned to AEU.
- Performs the duties of the Director of AEU Legal Matters in his/her absence.
- Prosecuting Department of Buildings (DOB) summonses at OATH.
- Prepares, argues, and assigns difficult and sensitive cases at OATH.
- Reviews OATH decisions and assigns/prepares appeals.
- Liaises with OATH managing attorneys and Borough Managers regarding the adjudication of DOB summonses.
- If necessary, travels to and works in all five OATH offices and/or the DOB assigned office.
- Legal writing, including the preparation of appeals, responses, motions, and other documents relating to the continuing prosecution of DOB summonses/violations.
- Promptly and accurately notify AEU senior staff of important developments and outcomes of hearings, adjournments, appeals, and other matters connected to cases.
- Pre-hearing preparation, including general research for upcoming cases and following up on previous cases handled.
- Performing in-house assignments relating to the prosecution, adjudication, and/or appeal of OATH summonses.
- Providing guidance, training, and support to junior attorneys who work at DOB.
- Oversee the training of DOB personnel as it relates to the issuance and/or the prosecution of summonses.
- Actively undertaking and participating in special projects and assignments.
- Any other duties as assigned.


Minimum Qualifications

1. Admission to the New York State Bar; and either "2" or "3" below.
2. One year of satisfactory United States legal experience subsequent to admission to any state bar; or
3. Six months of satisfactory service as an Agency Attorney Interne (30086).
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
In addition to meeting the minimum Qualification Requirements:
To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.


Preferred Skills

- Demonstrate initiative, resourcefulness, ability to work independently and as part of a team on multiple assignments with minimal supervision. - Experience with Building Code, Zoning, Multiple Dwelling Law or land use law. - Knowledge of Microsoft Office programs, Lexis-Nexis, West Law etc.

Residency Requirement

New York City residency is generally required within 90 days of appointment. However, City Employees in certain titles who have worked for the City for 2 continuous years may also be eligible to reside in Nassau, Suffolk, Putnam, Westchester, Rockland, or Orange County. To determine if the residency requirement applies to you, please discuss with the agency representative at the time of interview.
