The Civilian Complaint Review Board (“CCRB”) is an independent agency charged with investigating and mediating complaints which members of the public file against New York City police officers involving the use of excessive or unnecessary force, abuse of authority, discourtesy or the use of offensive language. The Board which governs the CCRB consists of 15 members, with five seats appointed by the Mayor, five appointed by the NYC City Council, three designated by the Police Commissioner, one appointed by the Public Advocate, and the Chair is appointed jointly by the Mayor and City Council. The Executive Director is responsible for the day-to-day operations of the agency. As the largest police oversight agency in the United States, the CCRB currently investigates approximately 4,500 complaints each year, and has Mediation, Outreach and Training Units. The CCRB is also charged with operating its Administrative Prosecution Unit (“APU”) which prosecutes all cases substantiated by the Board. The CCRB's Administrative Prosecution Unit (APU) is seeking a Chief Prosecutor. The APU is empowered to prosecute members of the New York City Police Department (NYPD) for disciplinary matters where the Board has substantiated a complaint and has recommended the filing of charges and specifications. The unit is headed by a Chief Prosecutor and is staffed with two Deputy Chief Prosecutors, ten prosecutors, three trial preparation assistants, and two administrative assistants. The Chief Prosecutor will report to the Executive Director and will be responsible for supervising all aspects of the APU.
The Chief Prosecutor’s responsibilities include, but are not limited to:
- Ensuring that prosecutors are prepared for trial;
- Developing APU procedures and strategies;
- Preparing briefs, motions, legal opinions and other legal documents;
- Negotiating plea agreements and recommending penalties when appropriate;
- Prepare monthly reports for the Executive Director on unit operations;
- Maintaining accurate and complete records of actions taken during the course of prosecutions;
- Assigning cases and ensuring that staff properly records data in the APU’s case tracking system;
- Coordinating the training of new staff in CCRB, APU, and NYPD procedures;
- Coordinating with the NYPD Department Advocate's Office as necessary;
- Coordinating with the attorneys for unions that represent members of the NYPD;
- Training of CCRB investigators;
- Sets an example for team by handling the prosecution and trial of several cases a year;
- Performing special projects and developing policy recommendations for CCRB's Board and Executive Director as needed; and
- Supervising the trial preparation assistants, interns and administrative staff assigned to the APU.
Admission to the New York State Bar; and four years of recent full-time responsible, relevant, satisfactory legal experience subsequent to admission to any bar, eighteen months of which must have been in the supervision of other attorneys, in an administrative, managerial or executive capacity, or performing highly complex and significant legal work.
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
Juris Doctor Degree and admission to the New York State Bar, with a minimum of seven years of relevant legal experience, including significant experience with criminal and/or administrative trials and familiarity with policing issues is preferred.
New York City residency is generally required within 90 days of appointment. However, City Employees in certain titles who have worked for the City for 2 continuous years may also be eligible to reside in Nassau, Suffolk, Putnam, Westchester, Rockland, or Orange County.
