Job Description

THE SELECTED CANDIDATE WILL BE OFFERED A SALARY BETWEEN $107,950.00 - $251,845.00

The Administration for Children’s Services (ACS) is responsible for the protection of New York City’s children and the support of the City’s families. ACS provides Head Start and Day Care Services; investigates reports of abuse and neglect; provides foster care and adoption services to families; manages facilities for justice involved youth and facilitates children’s and families’ access to appropriate preventive services.

The Division Family Court Legal Services (FCLS) is responsible for representing ACS in child neglect and abuse cases, permanency hearings, juvenile delinquency, and other child welfare proceedings in the New York City Family Courts. FCLS attorneys work collaboratively with Child Protective Specialists (CPS), foster and preventive case planners, and other child welfare stakeholders to further the agency’s mission on behalf of children and families.

Under the Direction of the Deputy Commissioner for Family Court Legal Services with great latitude to exercise independent judgment, the Associate Commissioner is responsible for assisting the Deputy Commissioner with the operation of the Division and all of its units, which is comprised of over 400 staff, citywide, and encompasses the following: Borough Court units, the Legal Support and Training Unit, the Legal Compliance Unit, the Title IV-E Compliance Unit, the Contract Unit and the Court Document Dissemination Unit. The Associate Commissioner will strive to ensure that ACS is working to achieve safety, permanency, and well-being for both children in its care and with their families by assisting the borough offices with legal issues, their implementation of Division policies and protocols, their effective use of available technology and data, their administrative issues as well as by integrating the tenets of various Agency initiatives into the Division’s practice.

Specific Duties and Responsibilities:

- Assist with general management and oversight of the borough offices, and attorney and non- attorney staff

- Supervise the Legal Support and Training Unit to ensure the FCLS attorneys are supported with relevant legal training, legal research, and policy guidance. Oversee the legal training provided to CPS, preventive and foster care case planners

- Supervise the Legal Compliance Unit to provide assistance to FCLS staff on foster care issues, ACS policy, ICWA, ICPC, QRTP motions, revocation hearings and general support for the various projects and work groups with other ACS divisions

- Review legislation and agency policies

- Maintain oversight of the Division’s technological issues including the Legal Tracking System and LUC, the data share project between ACS and the Office of Court Administration, and close collaboration with OIT

- Maintain oversight of the Division’s administrative issues including contracts with process server, expert witnesses, and court reporters

- Liaise with Division of Administrative Services on the offices’ facility issues

- Maintain oversight of the Division’s appeals process, and manage the Division’s relationship with the Law Department

- Maintain oversight of the Division’s training unit, Title IV-E unit, Contract Unit and the Court Document Dissemination Unit

- Assist in development and implementation of the Agency’s strategic plan, as well as the Division’s

- Assist in implementation of the specific tasks of the Division related to the Close to Home initiative

- Attend meetings on behalf of the Deputy Commissioner, including, but not limited to, meetings with executive Agency staff, personnel from the Office of Court Administration, and various stakeholders

Minimum Qualifications

Admission to the New York State Bar; and four years of recent full-time responsible, relevant, satisfactory legal experience subsequent to admission to any bar, eighteen months of which must have been in the supervision of other attorneys, in an administrative, managerial or executive capacity, or performing highly complex and significant legal work.

Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
