The NYC Department of Environmental Protection (DEP) enriches the environment and protects public health for all New Yorkers by providing 1.1 billion gallons of high-quality drinking water, managing wastewater and stormwater, and reducing air, noise, and hazardous materials pollution. DEP is the largest combined municipal water and wastewater utility in the country, with nearly 6,000 employees. DEP's water supply system is comprised of 19 reservoirs and 3 controlled lakes throughout the system’s 2,000 square mile watershed that extends 125 miles north and west of the city.

The Agency Chief Contracting Office ACCO is responsible for managing all agency procurement and payment activity in accordance with all applicable city and state laws and regulations including General Municipal Law, City Charter, local laws such as LL1 for MWBE, Procurement Policy Board Rules and NYC Comptroller Directives. ACCO works cooperatively with DEP’s bureaus in support of their operational and programmatic needs including procurement of capital construction and related professional services (design, engineering, and construction management services), maintenance and repair contracts, and a wide array of supply and standard service contracts. In addition, ACCO staff manages agency compliance with vendor performance evaluations, MWBE participation goals, opportunities and requirements, prevailing wage, labor law compliance and vendor management. ACCO processes hundreds of both large and small contracts and thousands of payment transactions procuring about $2 billion in contracts annually. The ACCO consists of ten (10) organizational groups: Competitive Sealed Bids, Procurement Administration, Technology Development & Innovation, Contract Administration, Contract Compliance and Opportunities, Purchasing Management, Payments & Accounting, Contracts Review and Negotiations, Large Payments and Accounting Management, and the Process Optimization & Change Management group.

The Office of Contract Compliance & Opportunities oversees different contract compliance areas including:
- Contract Opportunities: Enforcing Minority/Women Owned Business Enterprises and Locally Based Enterprise (MBE/WBE/LBE) program requirements as per NYC Local 1 and the State Revolving Fund. Equal Employment Opportunity: Division of Labor Services (DLS) Construction Employment Reports are required for: Construction contracts valued at or above $1,000,000 DLS Supply & Service Employment Reports are required for: Prime and Subcontractors valued at or above $100,000.
- Subcontractor Approvals:
All contractors who intend to subcontract work must provide DEP a completed subcontractor approval form along with the required back up documents, for a complete list of required documents; see Checklist (2-18 version). At a minimum, preliminary approval must be granted prior to a sub beginning work on or off site. This approval request must also be submitted in the NYC's Payee Information Portal (PIP) system.
- Prevailing Wage Unit:
This unit assures that all contractors and subcontractors working for DEP are paying prevailing wages as required under sections 220 and 230 of the New York State Labor Law or Davis Bacon. Construction titles have specific wages and benefits that must be paid by contractors on public works contracts. There are also prevailing wages and benefits under section 230 of the New York State Labor Law. DEP Sign-in sheets and Certified Payroll reports are required for all construction contractors and building service contractors on DEP projects.

Job Tasks/Duties:

Supervise staff as directed by the DACCO and assist in managing the day-to-day operations of the unit. Assist the DACCO with any issues that may arise during the review of subcontractor approval requests, prevailing wage or M/W/DBE audits. Develop outreach and networking opportunities, enforcement of city and state Minority Women Business Enterprise (M/WBE) requirements; work with engineers and program managers to develop contract specific goals, review submissions of utilization plans, other plans required by the City or State, and reviews payments and other documentation to ensure programs and contract requirements are met.

Prepare atypical solicitation documents; as required by the DACCO, review and recommend for approvals M/WBE Participation Goals, Project Labor Agreement (PLA) & Prevailing Wage applicability.

Responsible for developing initiatives to increase M/WBE participation on DEP projects; represent the Agency at M/WBE and small business contractor opportunity fairs; meet with contractors & contractor organizations to encourage participation of department contracts.

Submit compliance and other reports within the Agency.

Represent the Agency at meeting with other Agencies and Bureau staff.

Serve as liaison with the Mayor’s Office of Contract Services, the Office of the Comptroller, and other City Agencies.


Minimum Qualifications

1. A baccalaureate degree from an accredited college and four years of full-time satisfactory professional experience in purchasing, procurement, contract administration or a related field, at least eighteen months of which must have been in an administrative, managerial or executive capacity or supervising professional personnel performing duties in one or more of the above fields; or

2. A combination of education and/or experience equivalent to "1" above. However, all candidates must have the eighteen months of administrative, managerial, executive or supervisory experience described in "1" above.

Possession of an acceptable professional procurement certification may be substituted for up to one year of the experience described in "1" above. However, all candidates must have the eighteen months of administrative, managerial, executive or supervisory experience described in""1" above.

Residency Requirement

New York City residency is generally required within 90 days of appointment. However, City Employees in certain titles who have worked for the City for 2 continuous years may also be eligible to reside in Nassau, Suffolk, Putnam, Westchester, Rockland, or Orange County.
