Job Description

The NYC Business Integrity Commission is seeking an experienced attorney to join the agency’s Violations Unit. As part of the regulatory oversight, BIC issues administrative violations in both the trade waste industry and the public wholesale markets industry. The Violations Unit is responsible for the drafting, review, issuance, negotiations, litigation, and adjudication of all violations and summonses issued by the agency. The Violations Attorney will represent BIC on all cases heard before the Office of Administrative Trials & Hearings ( OATH’). The attorney will assist will all aspects of the violation process and will gain hands-on experience managing a caseload, working with investigators, negotiating settlements and appearing before an administrative tribunal.

Under supervision, the Violations Attorney duties and responsibilities will include, but are not limited to:
- Managing a daily caseload and independently representing BIC at administrative hearings and trials before OATH;
- Pre-hearing preparation, including general research for upcoming cases. Identifying and retrieving appropriate documents and evidence for hearings and trial;
- Evaluating case strengths and weaknesses to effectively negotiate plea and settlement agreements with respondents and/or their attorneys or representatives;
- Collaborating within the agency to prepare, approve and adjudicate administrative violations;
- Supervising Violations analysts and working with them to ensure cases are calendared with OATH;
- Performing in-house assignments relating to OATH/ECB adjudication of summonses and administrative violations issued by BIC, and
- Actively undertaking and participating in special projects and assignments.


Minimum Qualifications

Admission to the New York State Bar; and four years of recent full-time responsible, relevant, satisfactory legal experience subsequent to admission to any bar, eighteen months of which must have been in the supervision of other attorneys, in an administrative, managerial or executive capacity, or performing highly complex and significant legal work.

Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.


Preferred Skills

The preferred candidate should possess the following: - Experience with litigating administrative matters. Strong preference for experience with appearances before the OATH tribunal - Detail oriented and highly organized - Demonstrate initiative and ability to work independently - Capable of multi-tasking efficiently and effectively, and - Experience working collaboratively and as part of a team.

New York City residency is not required for this position.
